On Wednesday, the Court of The Hague determined that Samsung Galaxy products cannot be sold in the Netherlands because they infringe on Apple’s patents relating to photo-scrolling on touchscreen devices.

“The argument raised by Samsung at the hearing that Samsung Benelux does not sell the infringing products any more, cannot lead to a rejection of the ban,” Judge Peter Blok said, adding that he would grant the ban “because Samsung refused to sign a declaration of abstinence committing to not infringing the patent.”

The ban, however, only applies to Galaxy products running Android 2.2.1 and higher. The ban doesn’t include devices running Samsung’s proprietary photo gallery software.

Samsung is now required by the court to inform Apple of how how much the company earned from these products since June of 2011. The court will then determine how much of these profits must be paid to Apple.
